§ 1
- The Terms and Conditions regulate all important elements related to the operation of the Showroom (hereinafter referred to as SR).
- SR is run by Rest Lords Sp. z o. o., st. Tarasa Szewczenki 7 loc. 11, 10-274 Olsztyn, Poland, District Court in Olsztyn, 8th Commercial Division, KRS 0000780982, NIP 7393926470, REGON 383085620 (hereinafter referred to as RL), having the legal title to the premises where SR is located and is the owner of the equipment installed there.
- RL is also the Seller of goods, i.e. massage chairs, which are presented in SR.
- RL declares that it has appropriate third party liability insurance, and SR is covered by tort insurance.
- RL declares that the goods available for presentation in SR are certified and have the necessary approvals.
- SR is covered by a monitoring system and an alarm system operated by the local property protection agency.
- SR operates during the hours of the reservations, within the working hours published on the Seller’s website.
§ 2
- SR is a specially prepared place where the Customer can personally test the goods with remote support and service of a Customer Advisor (hereinafter referred to as CA).
- There is no physical customer service at SR.
- In SR, massage chairs available in the RL offer are available to the customer.
- SR in addition to the equipment described in section 2, is equipped with telecommunications equipment, i.e. a set of displays, cameras, speakers and microphones enabling the Client and CA to communicate remotely:
- CA remotely controls the functions of the living room, including: lighting, heating and air conditioning, and other telecommunications equipment.
- The client physically controls the functions of the massage chairs in accordance with the instructions provided remotely by CA.
- In SR, it is forbidden to consume drinks, food and alcohol, smoking cigarettes or electronic cigarettes and leaving garbage.
- SR does not have a toilet available to customers.
- Due to the comfort of testing massage chairs and the specificity of service at SR, it is recommended to have a maximum of two (2) adult clients visit at the same time.
- The presence of minors during a visit to SR is possible only under the full supervision of the minor’s legal guardians and under their sole responsibility.
- Persons under the influence of alcohol or other intoxicating substances are not allowed in SR.
- Pets are strictly prohibited in SR.
- Demonstrated goods in SR are not for sale. It is not possible to deliver goods from SR to the Customer.
§ 3
- A visit to SR can only be booked by correctly completing the booking form available on the website: booking.restlords.com.
- The customer selects the preferred time and date of the visit to SR from the calendar.
- The reservation form requires the main Customer’s personal data to be completed.
- Providing the correct data is necessary to confirm the reservation and communicate with the Customer.
- The bookable visit time is 60 minutes for a visit of up to 2 people.
- In order to confirm first reservation, the Customer pays a refundable reservation deposit.
- The value of the refundable reservation deposit is determined by the Seller and published at: booking.restlords.com.
- A refundable reservation deposit is collected for the purpose of confirming identity and booking CA’s working time.
- The reservation deposit is returned to the Customer immediately after the visit, using the same payment method in which it was made, and if this is not possible, to the bank account indicated by the Customer.
- During the second and subsequent reservation, the Customer pays the fee for the visit.
- The fee for each subsequent visit is PLN 150.
- The visit fee is collected for the purpose of reserving the CA’s working time and protecting against reservation abuse.
- If the client decides to purchase a massage chair during or after a visit to SR, the amount of fees incurred so far for visits will be fully deducted from the purchase price of the massage chair.
- Free cancellation or rescheduling of the visit is possible up to 24 hours before the planned start of the visit.
- If the Customer does not cancel the scheduled visit within 24 hours before its commencement, RL is entitled to retain the reservation deposit collected from the Customer referred to in section 6 or fees for the visit referred to in section 7, which will be used to cover the costs incurred by RL related to booking the visit at SR.
- If the Customer is late for the scheduled appointment for more than 30 minutes, the appointment may be canceled by RL with the Seller retaining the reservation deposit or visit fee.
- Due to subsequent scheduled visits, the duration of the visit is not extended by the time the Customer is late.
- In cases of random or emergency situations beyond RL’s control, CA may cancel the visit and immediately inform the Client.
- in the above situation, CA will offer the Client another possible date for visiting SR or refund the deposit paid or visit fee.
§ 4
- In the time between booking the date and the visit to SR, CA contacts the client by phone to briefly discuss:
- principles of SR operation and the testing process of massage chairs,
- advice on preparing for the visit,
- rules for the safe conduct of the visit.
- After telephone contact, an SMS text message will be sent to the telephone number provided by the main Customer, containing the SR access code that opens the entrance door lock.
- The code can’t be shared with third parties outside the list of provided guests.
§ 5
- The received access code described in § 4 section 2 should be used by entering it into the numeric panel located at the SR entrance door.
- The access code only works during the scheduled appointment time and expires after its completion.
- Re-entering SR requires entering the access code again.
- After entering the access code, the entrance door to SR opens automatically.
- The doors to SR close automatically, but the Customer should make sure that the doors are closed.
- The customer may enter SR only with one accompanying person.
- Exiting the salon is not secured in any way and does not require entering an access code.
§ 6
- During the visit, you are automatically connected to the CA.
- The client who wants to receive a massage should:
- put outerwear on a designated hanger,
- put bags in a designated place in SR,
- empty pockets of any personal items (including wallet, phone) that could fall out during the massage and put them in the designated place in the SR,
- remove any jewelry (e.g. watch, bracelet) that could interfere with the massage and put it in a designated place in SR.
- During the visit, CA may instruct one customer to use one model at a time.
- The client cannot operate the massage chairs without the consent and supervision of CA.
- Massage chairs may only be used for their intended purpose.
- The client should communicate to the CA the current state of well-being, and in particular react to any discomfort.
- CA can remotely stop the massage in the massage chair.
- During your visit, you can place an order for a massage chair, which will be accepted remotely by CA.
- After completing the visit, the Customer should make sure that he or she has taken away all personal items brought to SR, described, among others, in section 2.
- RL is not responsible for items left by the Customer in SR.
- Items found in SR will be sent back to the Customer by courier at his request and at his expense.
- Customers cannot enter SR outside of their booked appointment.
- When leaving SR, the Customer is obliged to make sure that the door is properly closed.
§ 7
- In the event of a remote connection failure, CA will contact the Customer at the telephone number provided in the form, presenting the further procedure.
- In the event of a power failure, SR has a voltage maintaining device (UPS), and CA will notify the Customer about the failure, presenting the further procedure.
- In the event of a failure of the massage chair or individual devices in the SR, CA, together with the client, will decide whether the visit can be continued or whether it is necessary to end it.
- In the event of a fire in the SR building, the fire protection system will notify the CA and the Customer about this fact, and the emergency lighting will turn on, indicating the exit point.
- Fire extinguishers or fire hydrant are available in SR.
- The fire safety procedure manual is provided by the Building Administrator and is available at the headquarters of mKwadrat at st. Uranowa 22 in Warsaw and the security office located in the building at Płosa 1.
- In the event of a client fainting or poor health, CA notifies the emergency services and remotely provides them with access to the SR.
- In the event of violations of the SR regulations, acts of vandalism, or theft, CA will interrupt the visit and ask the clients to leave the SR, and in special cases, call the Security Agency or the Police.
§ 8
- Staying in SR takes place at the request of the Customer, at his will and with his consent and under his full responsibility.
- The Customer undertakes to comply with the rules of the Terms and Conditions, which the Customer is obliged to read before booking a visit to SR.
- The condition for successfully arranging a visit to SR is the Customer’s acceptance of these Terms and Conditions during the process of booking a visit to SR.
- The client is obliged to familiarize himself with the contraindications regarding massage and the rules of activity of SR.
- The client is obliged to report any doubts to CA before the visit, in particular his or her own contraindications to the massage and other indispositions, if any.
- The use of the massage chair at SR is at the customer’s responsibility.
- If the Client has doubts whether his/her health condition allows him/her to visit the SR, or if the Client has any medical conditions that constitute a contraindication to a massage on a massage chair, before the first massage session on a massage chair at the SR, he or she should consult the possibility of carrying it out with a doctor.
- When using SR, in order to ensure the safety of the Client and RL’s property located in SR, the Client is obliged to follow CA’s orders and instructions.
- The Customer is personally liable for damage to RL’s property caused by the Customer’s action or omission, including behavior inconsistent with CA’s orders or instructions.
§ 9
The processing of personal data is carried out in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/ EC (General Data Protection Regulation) OJ L 2016 No. 119, page 1, as amended. and national regulations. Rest Lords Terms and Conditions for the use of the Rest Lords free Wi-Fi network
- These Terms and Conditions set out the principles and scope of use of the free wireless computer network (Wi-Fi) service hereinafter referred to as the “Network”. – made available by the Administrator, i.e. REST LORDS Sp. z o.o. with its registered office in Olsztyn, 7 Tarasa Szewczenki Street, # 11, 10-274 Olsztyn, possessing the KRS number 0000780982, NIP number 7393926470 and REGON number 383085620, within the area of its coverage and apply to anyone who connects to the Network.
- The Network is available to users of the Rest Lords massage chair showroom present on the premises at 1 Płosa Street, #U3, 03-531 Warsaw, Poland. The Network allows the use of HTTP and HTTPS protocols via standard web browsers.
- The regulations are available on the website: restlords.com/en/regulamen-wifi-warszawa/.
- Use of the Network implies acceptance of these Terms and Conditions. By using the Network, the user declares that he/she has read the terms and conditions and accepts them. The User’s failure to read or understand the Terms and Conditions does not relieve the User of the responsibility to comply with them.
- The Network is available to Rest Lords showroom users free of charge. The service of accessing the Network is not a service of a commercial nature. The Network is protected by a password, which can be obtained from a Rest Lords Customer Advisor.
- Users undertake to use the Network in a manner consistent with applicable law and the rules of social coexistence.
- Users may not use the Network for activities that infringe copyright, the privacy of others or for illegal activities.
- Users shall ensure on their own and at their own expense that they can use their device and that it is protected against unauthorised access by third parties, as well as that they are equipped with appropriate anti-virus software and that their device is compatible with the Network. Users are responsible for the security of their devices when using the Network.
- The Network Administrator is not responsible for any loss or damage caused by the use of the Network.
- The Administrator does not guarantee: the availability of all network, application and Internet services; the constant bandwidth of the link and its other parameters; the continuous coverage of the facility with a radio signal; the uninterrupted, correct, uninterrupted operation of the Network.
- The Administrator is not responsible for interruptions in access to the Network and for technical conditions in the Network, as well as for delays that may affect the actual transfer (i.e. the quality of transmission and the speed of data transmission) to and from the User’s device, including those resulting from maintenance work, technical faults and other unforeseen random events.
- The Administrator has the right to impose, without notice and prior notice, limitations on the connection time, bandwidth, data transmission limit and other parameters related to the data transmission of the Network.
- The Network Administrator reserves the right to disconnect a user from the use of the Network.
- Each User, when connecting to the Network, undertakes to:
- use the Network for lawful purposes,
- not to make available, transmit or download any content from the Network, which are illegal or whose ownership rights do not belong to the User,
- not to use the access to the Network for the dissemination of unsolicited advertising or any other content, so-called spam,
- not to distribute computer viruses or other programs, files or content that may damage the equipment of other Network Users,
- not to violate the security measures applied on the Network.
- In particular, it is strictly prohibited to:
- sharing and downloading copyrighted material (software, films, music, etc.) from the Network, as well as content prohibited by generally applicable laws, i.e., inter alia, racist, fascist, paedophilic, pornographic, etc. content,
- use of applications and computer programs for downloading files by the Network User, e.g. P2P, P12M, or Torrents,
- further distribution, sharing of signal through the use of repeaters, routers, antennas, cables, etc. devices,
- running server services on devices connected to points providing free and Wireless Network,
- distribution of malicious software, i.e. any application, script, etc., having harmful, criminal or malicious effects on other Internet users or capable of damaging the computers of other Internet users
- reselling access to the Internet,
- any other activity of the User that may be considered dangerous to the functioning of the Network or contrary to generally applicable law.
- The Administrator is not responsible for the content distributed by the Users of the Network, as well as for the websites opened by the Users or other activities or actions conceived by the Users in the Network. The Administrator is not responsible for any interruption in access to the wireless network and any resulting damage incurred by the Users.
- The Network Administrator does not process personal data within the meaning of Article 4(2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons about the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) OJ L 2016 No. 119, p. 1, as amended.
- The Network Administrator reserves the right to amend these rules at any time.
- Changes to the rules will be published on the website or in another publicly accessible place.
